COMPREHENSIVE HUMAN RESOURCES POLICIES AND PROCEDURES MANUAL - DRUG TESTING CONSENT FORM
INTRODUCTION
This section of the comprehensive human resources policies and procedures manual contains a drug testing consent form. It is completed by job applicants or employees and provides the employer with consent to have the individual tested for drugs and/or alcohol abuse. In terms of the Employment Equity Act, Medical testing of an employee is prohibited, unless legislation permits or requires the testing; or it is justifiable in the light of medical facts, employment conditions, social policy, the fair distribution of employee benefits or the inherent requirements of a job.
Medical Testing includes any test, question, inquiry or other means designed to ascertain, or which has the effect of enabling the employer to ascertain, whether an employee has any medical condition.
It is always advisable to treat workplace drug related incidents in terms of a Medical Incapacity Process.
