DRUG TESTING CONSENT FORMS

 

INTRODUCTION

In terms of the Employment Equity Act, Medical testing of an employee is prohibited, unless legislation permits or requires the testing; or it is justifiable in the light of medical facts, employment conditions, social policy, the fair distribution of employee benefits or the inherent requirements of a job.

Medical Testing includes any test, question, inquiry or other means designed to ascertain, or which has the effect of enabling the employer to ascertain, whether an employee has any medical condition.

It is always advisable to treat workplace drug related incidents in terms of a Medical Incapacity Process.
